Terms & Conditions

INTRODUCTION

1. By agreeing to start a project with me, the designer, you are agreeing to read and fully agree to my terms of service.

2. I will not tolerate any ill behavior toward myself or my work.

3. I reserve the right to refuse any client or any project under any condition.

4. I do NOT authorize using any of my pieces, both personal or commissioned pieces, as non-fungible tokens (NFT). Additionally, I do NOT authorize using any of my pieces to feed any artificial intelligence (AI) generator or use in an AI generator in any way. Any work commissioned from me excludes any copyrights pertaining to the use in conjunction with, or association with, NFTs or AI generators.

5. All preparation materials, visuals, and sketches, including all electronic files used to create the project, remain the property of Oddishin Graphics. This includes any outline materials, rejected designs, or any other artistic materials used in the design process that were not included in the final product.

PRICING

4. All pricings are listed in USD. I accept such payment forms as Stripe, Venmo, Cash App, and PayPal.

5. The client has the right to choose if they will submit payment as a 100% upfront downpayment, or as a 50% deposit upfront with the remaining balance being received by the designer before the final product is sent to the client. Once an initial deposit has been received, it will be non-refundable unless I am unable to complete the project for any unjustifiable reason.

6. If I am unable to complete any project for any unjustifiable reason and the client has submitted the full payment upfront, the client is then entitled to a full refund.

          a. If the client requests to discontinue services during a project or is unsatisfied with the final product, they may be entitled to

              a refund outside of the non-refundable deposit.

7. Pricing will vary depending on the complexity of the overall design, amount of individual variables contributing to the design, or any other elements I deem fit. This final price will be determined and agreed upon before any work is started.

8. The client will receive an invoice in the final package email that outlines the details of the transaction for tax purposes.

9. If the project is canceled by the client before it has been completed, the client is subject to a cancellation fee totaling 20% of the remaining balance after the initial deposit.

10. Following the final, full payment as confirmed by the designer, the client will have full copyrights to any assets or deliverables included in the final design package.

11. For projects over $200, the client may discuss a variety of payment plan options with me.

SERVICES

12. My work is mainly specialized in event flyers, social media management, poster & print design, logo design, and general promotional material design. While this is my primary work, I am open to discussing alternative project syles with the client.

13. When discussing the details of a project, we will agree on a deadline that fits both the client’s needs and my own schedule. If the client requests a rush order (a project needed within three days of the first deposit received), an additional 30% charge will be added to the total cost of the project.

14. For any project, the client is allowed three (3) revisions free of cost. Any additional revisions after the three (3) free alterations will be charged 5-20% of the base price, depending on complexity at the designer’s discretion.

15. Standard project assets will be included in an email package as PNG files for general assets and SVG files for logos or other vector-based designs. The client may request the Photoshop file (PSD) for their own future edits as well as request any other file types for commissioned material (ex. JPG).

COPYRIGHTS

16. Following the completion of the commission and the final payment, the client will be granted personal-use copyrights to:

          a. Claiming the poster as their own marketing/creative material commissioned by me.

          b. Sharing and/or reposting the commissioned materials any place they see fit.

          c. Printing the commissioned materials for non-commercial use.

17. By default, any quotes, estimates, or listed pricings are based on personal-use copyrights exclusively. Commercial-use rates are available and can be negotiated with me.

18. Any misuse of copyrights outside of what was established will be considered ill behavior and may result in the termination of any further work.
